These Terms of Service ("Terms") govern your purchase of products from Pro Drive Auto Parts ("Pro Drive," "we," "us"), located at 5 W Mendenhall St STE 202, Bozeman, MT 59715. By placing an order on prodriveautoparts.com (the "Site") you agree to these Terms.
1. About our products
Pro Drive sells pre-owned automotive engines, transmissions, and related parts. All units are inspected and tested before shipment. Photographs of the actual unit are shared with you for approval before crating.
2. Orders and order acceptance
All orders are subject to acceptance and product availability. We may decline or cancel any order at our discretion, including for suspected fraud, pricing or description errors, or inability to verify fitment. If we cancel a paid order, you will receive a full refund to the original payment method.
3. Pricing and payment
All prices are shown in U.S. dollars and may change without notice. You authorize us to charge your payment method for the full order total, including any applicable taxes and shipping. Payments are processed by industry-standard providers; we do not store full payment card data on our servers.
4. Shipping
Free freight shipping is provided to addresses in the 48 contiguous United States unless otherwise stated. Delivery timeframes are estimates, not guarantees. Title and risk of loss pass to you upon delivery. See our Shipping Policy for full details, including delivery scheduling and damage-claim procedures.
5. Warranty
Used engines and transmissions are covered by the warranty terms set out on our Warranty page (typically 6 months on standard units, with longer coverage available on premium units). The warranty covers internal mechanical failure under normal use; it does not cover damage from improper installation, oil starvation, overheating, or pre-existing vehicle issues. Proof of professional installation may be required for warranty claims.
6. Returns and refunds
Defective or mis-described units may be returned within 30 days of delivery for a full refund, subject to our Return & Refund Policy. Photograph any visible freight damage at delivery before signing, and contact us within 48 hours of receipt to report it.
7. Fitment
We make commercially reasonable efforts to verify fitment from the VIN you provide. You are responsible for the accuracy of vehicle information you submit. If a unit is incorrect due to inaccurate VIN information you provided, return shipping may be at your expense.
8. Limitation of liability
To the maximum extent permitted by law, Pro Drive's total liability for any claim arising out of or relating to a product or these Terms is limited to the amount you paid for the product. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, downtime, towing, rental vehicles, or labor charges.
9. Disclaimers
Except as expressly stated, products are sold on an "as-is" basis and Pro Drive disclaims all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
10. Intellectual property
All content on the Site (text, images, logos, layouts) is owned by or licensed to Pro Drive and protected by intellectual property laws. You may not copy, reproduce, or use Site content for commercial purposes without our written permission.
11. Communications
By providing your phone number or email, you consent to receive transactional communications about your order and quotes. You can opt out of marketing emails at any time using the unsubscribe link.
12. Governing law
These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Gallatin County, Montana.
13. Changes
We may update these Terms from time to time. Updated Terms take effect when posted on this page. Continued use of the Site after changes means you accept the updated Terms.
