Agreement. By placing an order on prodriveautoparts.com, you agree to these Terms of Service and to our Return & Refund Policy, Shipping Policy, Warranty Policy, and Privacy Policy. Please read them carefully before purchasing.

Products. All engines and transmissions sold by Pro Drive Auto Parts LLC are used parts unless explicitly stated otherwise. Product descriptions, mileage, and compatibility information are provided in good faith and to the best of our knowledge.

Order Acceptance. When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it and process payment. We may cancel an order after submission if information is inaccurate, if an item is mispriced or unavailable, or if we suspect fraud, and we will attempt to notify you using the contact details you provided.

Prices, Errors & Payments. All prices are in USD and payment is due at the time of order placement. Product descriptions, pricing, availability, and transit estimates may occasionally contain errors; we reserve the right to correct such errors and to change or cancel orders (including after submission) if any information was inaccurate, without prior notice.

Personal Use. You represent that your purchase is for your own personal or business use and not for commercial resale or export.

Warranty. All parts include a standard 6-month warranty, extendable to up to 3 years at purchase. Warranty covers part failure under normal use and does not cover damage caused by improper installation, misuse, overheating, oil starvation, or accidents. Covered claims are remedied by a replacement unit as described in our Warranty Policy.

Disclaimer of Warranties. Except for the express limited warranty we provide, and to the fullest extent permitted by law, all products are sold "AS IS" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow certain disclaimers, so parts of this may not apply to you.

Shipping, Title & Risk of Loss. Delivery times are estimates and are not guaranteed. Once we transfer a unit to the carrier, title and risk of loss pass to you. Freight damage must be handled per the delivery-inspection procedure in our Shipping Policy.

Cancellations & Refunds. Please refer to our Return & Refund Policy for full details on cancellations, returns, restocking, and freight responsibility.

Limitation of Liability. To the fullest extent permitted by law, Pro Drive Auto Parts LLC is not liable for any incidental, indirect, punitive, special, or consequential damages arising from the use or inability to use our products, including labor costs, diagnostic time, towing, rental vehicle expenses, lost profits, or downtime. Our total liability for any claim shall not exceed the amount you paid for the product.

Indemnification. You agree to indemnify, defend, and hold harmless Pro Drive Auto Parts LLC and its officers, employees, and agents from any claims, damages, liabilities, and reasonable attorneys' fees arising from your breach of these Terms, your violation of any law or the rights of a third party, or your use or installation of a product.

Governing Law & Venue. These Terms are governed by the laws of the State of Montana, and you consent to venue and personal jurisdiction in the state and federal courts located in Montana.

Severability; Waiver; Entire Agreement; Assignment. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the policies referenced here, are the entire agreement between you and us. You may not assign these Terms without our written consent; we may assign them without notice.

Changes to Terms. We reserve the right to update these Terms at any time. Continued use of our website constitutes acceptance of the updated Terms.

SMS / Text Messaging Terms. By providing your mobile number (including through our VIN or quote forms) and opting in, you consent to receive recurring SMS/MMS messages from Pro Drive Auto Parts related to your quote requests, orders, shipping, warranty claims, and customer support.
